Common Questions Addressed by Social Security Lawyers
It’s normal to have lots of questions and concerns if you’re a senior, unable to work due to a disability or living with serious injuries from an on-the-job injury. So, let’s take a look at a few of the most common questions and concerns that Attorney Tony Adderley and his legal team addresses with clients.
What is SSI?
SSI or Supplemental Security Income is a U.S. government program that offers benefits to low-income individuals who are age 65 or older or suffering from a disability or blindness.
This federal program is actually not funded by the Social Security trust fund; rather, it’s funded by the U.S. Treasury’s general fund, which is replenished by tax revenue.
SSI is intended to provide financial help to individuals who are unable to make ends meet and require help with funding for basic living expenses such as food, clothing, and shelter.
What is SSD?
SSD or Social Security Disability benefits (also called SSDI) are provided to individuals suffering from a serious disability or medical condition that leaves them unable to work for a period of one year or longer. SSD is also made available to individuals who are suffering from a condition that is ultimately expected to result in death.
Social Security Disability payments are issued on a monthly basis and in order to be eligible, you typically need to have worked for a certain timeframe at a job that pays into the Social Security Disability fund.
In order to secure SS disability benefits, you typically need to have a formal diagnosis from a physician. Applicants are also evaluated for their ability to perform the same work they performed previously and their ability to perform a different type of work. In evaluating the latter, the Social Security Administration will evaluate your medical condition, age, education, work experience, and skills, amongst other factors.
If you are currently working in limited capacity, you may not qualify if you’re earning more than an average of $1,130 per month (as of November 2016).
If you are receiving SSD when you reach full retirement age, you will continue to receive the same amount, except the benefits will now be considered Social Security retirement benefits.
Each case is unique and it’s not uncommon for an individual’s first claim to be wrongfully denied, so it’s helpful to have an experienced Social Security lawyer who can guide you through the application process.
What is Unfavorable Decision Litigation?
Attorney Tony Adderley is available to help litigate cases where an application for benefits has been denied. A number of factors are considered when appealing a denied claim, such as work capacity, medical records and beyond.
A Social Security attorney can also help you to address cases where there have been a miscalculation in your benefits or cases involving a legal error on the part of an administrative law judge (ALJ) who ruled on your case.
How Does a Lawyer Help with Workers’ Compensation Cases?
Workers’ compensation is a form of insurance that many employers obtain in order to provide employees with benefits in the event that they are injured on the job. Workers’ compensation is designed to help the employee in a financial sense as they recover and prepare to return to work, so in these instances, the disability or injury is typically more short-term in nature. Workers’ compensation will typically also pay for rehabilitation and medical care that’s required to help you get back to work.
A workers’ comp cases can also involve many challenges — challenges that are similar to those that you might encounter when seeking Social Security benefits.
